Ámbar Beach — Seasonal letting (Art. 3 LAU) in Calpe, Alicante

1. Nature of the contractual relationship

The Ámbar Beach property belongs to Mr Ricardo Luri Bolinski, Spanish tax number 48668172B. The property is offered exclusively as a seasonal letting under Article 3 of Spanish Law 29/1994 of 24 November on Urban Leases (LAU).

This is not a tourist accommodation property (VUT), tourist accommodation or a hospitality contract. Consequently, the property falls outside the scope of regional tourism legislation, of Decree 10/2021 of the Generalitat Valenciana and of the registration and reporting duties under Royal Decree 933/2021. The landlord does not provide the complementary services typical of the hotel industry (reception, catering, regular cleaning during the stay, daily change of linen, etc.).

Address of the property: Av. Juan Carlos I, 50, 03710 Calpe, Alicante, Spain.

2. Booking process

The apartment is booked through the following steps:

  • Checking availability: the user selects the desired dates using the calendar on the Website.
  • Booking request: the user completes the booking form with their personal and billing details.
  • Confirmation: the landlord will check availability and send the user an email confirmation with a summary of the booking and the payment instructions.
  • Payment: the booking is formalised once payment has been received in accordance with the conditions set out in section 3.
  • Signing the agreement: after payment has been confirmed, the tenant will electronically sign the seasonal letting agreement (Art. 3 LAU) using the link received by email.
  • Arrival instructions: once the agreement has been signed, the tenant will receive by email the arrival instructions, the access codes and all the information needed to collect the keys.

A booking request does not constitute a firm booking until the landlord confirms it and the corresponding payment is received.

3. Prices, payments and deadlines

a) Prices

The prices shown on the Website cover the accommodation for the number of nights booked. Final cleaning charges and any other additional items will be itemised separately during the booking process. All prices are in euros and include the applicable taxes.

The landlord reserves the right to change prices at any time, without this affecting bookings already confirmed.

b) Payment methods

The following payment methods are accepted:

  • Bank transfer (SEPA): no fees. The bank details will be provided in the booking confirmation.
  • Bizum: the associated telephone number will be provided in the booking confirmation.

c) Payment deadlines

The full amount of the booking must be paid within a maximum of 3 days from the date the booking is confirmed. If payment has not been received within that period, the booking will be cancelled automatically with no right to any claim.

4. Cancellation policy

The cancellation and refund conditions applicable to bookings are set out in our Cancellation Policy, which forms an integral part of these Terms and Conditions.

In summary:

  • Cancellation more than 60 days in advance: 100% refund.
  • Cancellation between 30 and 60 days in advance: 50% refund.
  • Cancellation less than 30 days in advance: no refund.

5. Right of withdrawal

In accordance with Article 103(l) of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Act for the Protection of Consumers and Users, and in line with Article 16(l) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal does not apply to contracts for the provision of accommodation services for purposes other than residential, where the contract provides for a specific date or period of performance.

Therefore, once a booking has been made, the 14-day right of withdrawal generally provided for in consumer legislation does not apply. Cancellations are governed exclusively by the Cancellation Policy referred to in section 4.

6. Check-in and check-out times

  • Check-in: from 5:00 p.m.
  • Check-out: before 11:00 a.m.

The tenant must respect the times set out above. If a different time is needed, it must be requested from the landlord in advance; the landlord will consider it according to availability and may accept or refuse it at their discretion. Arrivals outside these hours may be subject to an additional charge.

7. Tenant's obligations

The tenant undertakes to comply with the following obligations during the stay:

a) Care of the property

The tenant will use the apartment and its equipment with due care, keeping the property in a good state of repair and reasonably clean. At the end of the stay, the apartment must be returned in a condition similar to that in which it was received, allowing for normal wear and tear.

b) House rules

  • Holding parties or events in the apartment is strictly prohibited.
  • Neighbours' rest must be respected, particularly between 10:00 p.m. and 8:00 a.m. Making noise above the levels permitted by Calpe's municipal rules is prohibited.
  • The number of occupants may not exceed the number stated in the booking confirmation.
  • Smoking inside the apartment is not permitted.
  • Pets are not allowed unless expressly authorised in advance by the landlord.
  • Any illegal activity in the property is prohibited.

c) Building rules

The tenant undertakes to respect the rules of the building's owners' association, including those relating to the use of communal areas (swimming pool, terrace, car park, etc.).

d) Identification of the tenant

The tenant must provide the landlord with the documentation required (national ID, NIE or passport) to properly formalise the seasonal letting agreement, as well as their habitual residence and the stated temporary purpose of the stay.

8. Liability for damage and security deposit

The tenant will be liable for any damage, deterioration or loss caused to the apartment, its furniture, equipment or belongings during the stay, whether intentional or negligent, including damage caused by companions or guests.

The landlord reserves the right to request a security deposit before arrival, the amount of which will be communicated to the tenant during the booking process. That deposit will be returned in full once the condition of the apartment has been checked at the end of the stay, less the cost of any damage identified.

If the cost of the damage exceeds the amount of the deposit, the tenant undertakes to pay the difference within 10 calendar days of the landlord's notification, which will be accompanied by the corresponding supporting documentation (photographs, repair quotes, invoices, etc.).

9. Landlord's liability

The landlord warrants that the apartment is in an appropriate condition of habitability, safety and cleanliness, and that it has all the services and equipment described on the Website.

However, the landlord will not be liable for:

  • Incidents arising from supply cuts (water, electricity, internet) caused by the utility companies or by circumstances beyond the landlord's control.
  • Valuables, money or other property left in the apartment by the tenant.
  • Damage or loss arising from the tenant's failure to comply with the rules on the use of the apartment or with the owners' association rules.
  • Building works, noise or other nuisances in the surroundings of the building that are beyond the landlord's control.

10. Force majeure

Neither party will be liable for failure to perform its obligations where that failure is due to force majeure, meaning unforeseeable and unavoidable circumstances beyond the parties' reasonable control, including but not limited to: natural disasters, pandemics, epidemics, states of alarm or emergency, armed conflict, general strikes, government travel restrictions or any other similar circumstance.

In the event of force majeure preventing the stay, we will endeavour to offer the tenant alternative dates or, failing that, a full refund of the amount paid.

11. Immediate termination for breach

The landlord reserves the right to terminate the stay immediately and with no right to a refund in the following cases:

  • Holding unauthorised parties or events.
  • Exceeding the maximum number of occupants permitted.
  • Intentional damage to the property or its installations.
  • Illegal activities in the apartment.
  • Repeated breach of the house rules after a warning has been given.
  • Providing false information during the booking process.

12. Data protection

The personal data provided by the tenant during the booking process and the stay will be processed in accordance with our Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

13. Applicable law and jurisdiction

These Terms and Conditions are governed by and construed in accordance with Spanish law. For the resolution of any dispute arising from the interpretation or performance of these Terms and Conditions, the parties expressly submit to the jurisdiction of the Courts of Alicante, expressly waiving any other jurisdiction that may correspond to them, unless the legislation in force on the protection of consumers and users imperatively establishes a different jurisdiction.

14. Acceptance of the Terms and Conditions

Making a booking implies the tenant's full, express and unambiguous acceptance of these Terms and Conditions. The landlord reserves the right to amend these Terms and Conditions at any time; the version in force at the time of the booking will apply.
